Terms of Service
Last updated: April 22, 2026. These terms govern your use of CreativeTechCoderz services. Month-to-month. No lock-in. Just honest terms.
1. Agreement
These Terms of Service (“Terms”) govern the services provided by CreativeTechCoderz (“Agency”) to clients (“Client”). By engaging our services, you agree to these Terms in full.
2. Services
The Agency agrees to provide digital marketing services as specified in each signed Service Agreement or Proposal. Services commence on the agreed start date and continue on a month-to-month basis unless otherwise stated. Specific deliverables, timelines and scope are documented in each individual Service Agreement.
3. Month-to-Month Contracts
All services operate on a rolling monthly basis. Either party may terminate services with 30 days written notice. There are no minimum term commitments, no exit fees, and no penalty charges for early termination. Final invoices cover work completed through the end of the notice period.
4. Payment Terms
Monthly retainer invoices are issued on the 1st of each month and due within 14 days. Project-based work invoices are due within 14 days of issue. Late payments accrue interest at 1.5% per month. The Agency reserves the right to suspend services for accounts more than 30 days overdue.
5. Intellectual Property
Upon full payment, all creative assets, written content, and deliverables produced by the Agency for the Client become the Client's property. Agency retains the right to display work in its portfolio unless otherwise agreed in writing. Pre-existing Agency tools, frameworks, and methodologies remain Agency property.
6. Client Responsibilities
The Client agrees to provide timely access to necessary accounts, assets, and approvals; to provide accurate information about their business and objectives; to designate a primary point of contact with authority to approve work; and to notify the Agency of any changes to business circumstances that may affect campaign strategy.
7. Confidentiality
Both parties agree to keep confidential all proprietary business information shared during the engagement. This obligation survives termination of services.
8. Limitation of Liability
The Agency's total liability shall not exceed the fees paid in the three months preceding any claim. The Agency is not liable for indirect, consequential or punitive damages, or for losses arising from third-party platform policy changes (including Google algorithm updates, Meta policy changes, or App Store guideline revisions) that are outside the Agency's control.
9. Governing Law
These Terms are governed by the laws of the State of New York, USA. Any disputes shall be resolved in the courts of New York County.
